Disabled persons and the right to health

Dr André den Exter discussed what has been done about the access to healthcare for disabled persons through the European Court of Human Rights.

Dr André den Exter from the Erasmus School of Law, Erasmus University Rotterdam, gave the lecture on November 19th via Zoom. He pointed out that on different occasions, the European Court of Human Rights has dealt with access to healthcare issues, notably concerning vulnerable groups like disabled persons. Although not explicitly recognized under the Convention, implicitly, the Court has applied individual rights, creating positive state obligations under the Convention. In his presentation, den Exter explained the meaning of those so-called positive state obligations to CoE member states, which focus on disabled persons. His lecture was backed up by a great number of case studies from different countries. After the talk, the discussion mainly focused on intriguing examples from the Serbian healthcare system.

This lecture was the eleventh in the 2024 series of seminars on “Philosophy and Psychiatry” organized by the Center for Philosophy at the Institute of Social Sciences.
