Roundtable “Current issues of Medical law – Theory, Practice and Legislation 5″

The Roundtable “Current issues of Medical law – Theory, Practice and Legislation 5” was held on April 12, 2024. in cooperation with the Institute of Social Sciences, the Centre for Legal Research, on the one hand, and the Bar Association of Vojvodina, the Journal of Legal theory and practice of BAV, on the other hand. The meeting was attended by twelve panelists who presented their research, emphasizing numerous legislative problems in realizing the right to healthcare. The roundtable took place in two thematic units: 1) Current issues of international health regulation, and 2) Current medical and related laws in a broader sense.

The main topic of the Roundtable relates to issues of International Health Regulation, which have become particularly important after the period of the Covid-19 pandemic. The World Health Organization and other actors in the sphere of global health and human rights related to health are the bearers of numerous activities, including the European office of the WHO and the activities of the European Commission. The work on the adoption of the new health regulation, which began in the midst of the Covid-19 pandemic, in June 2020, was followed by numerous controversies and reactions from organizations for the protection of human rights, which dispute some of the proposed solutions of the new regulation. The focus of the discussion was the question of whether the proposed rulebook is a legally binding act or a voluntary act in the form of a “pandemic agreement”.

The second part of the Roundtable was devoted to current issues of medicine and related branches of law. First, taking into account the current personnel and organizational policy in the health system, the right to accessible and efficient healthcare in Serbia and neighboring countries was analyzed. In the continuation of the meeting, the legal and ethical issues of medical research on humans, the provisions of the Law on Biomedically Assisted Fertilization in the light of domestic court practice, obstetric violence, as well as parental duties regarding the child’s health protection were analyzed. Furthermore, the problems and obstacles in the creation of the guidelines of the new national strategic framework for rare diseases were considered. In addition, the need to regulate psychosocial risks with the aim of protecting mental health at workplaces was pointed out. Finally, taking into account modern scientific and technical achievements, the legal position of nanorobots in human medicine was considered.

Participants of the Roundtable are renowned scientists, professors from institutes and faculties from Belgrade, Banja Luka and Kosovska Mitrovica, as well as guests from Poland.
